TariffClassify is an AI-powered research tool. Classifications produced by this Service are not legal advice and do not constitute a formal tariff ruling or binding classification determination. All results must be independently verified by a licensed customs broker, trade attorney, or U.S. Customs and Border Protection (CBP) binding ruling before use in any import or export transaction. Reliance on AI-generated classifications without professional verification may result in misdeclaration, penalties, or delays.
1. Acceptance of terms
By accessing or using tariffclassify.ai (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all users, including free, registered, and paying users.
2. Description of service
TariffClassify provides AI-assisted Harmonized Tariff Schedule (HTS) code classification for informational and research purposes. The Service uses large language models to analyze product descriptions and suggest applicable HTS codes under the 2026 Harmonized Tariff Schedule of the United States (HTSUS).
3. No legal advice — critical disclaimer
The classifications, duty rates, reasoning, and all other output produced by TariffClassify are provided for informational purposes only and do not constitute legal advice, customs advice, or any formal ruling.
Specifically:
- Classifications are generated by an AI model and may be incorrect, incomplete, or outdated.
- HTS classifications are complex legal determinations that depend on specific facts, CBP regulations, court decisions, and binding rulings that the AI may not have access to or may misapply.
- Duty rates, trade program eligibility (e.g., GSP, USMCA), and Section 301 tariffs change frequently and may not be reflected in AI output.
- Only CBP can issue a legally binding ruling (Form 19) for a specific product.
- You should consult a licensed customs broker or trade attorney before using any classification for an actual import or export transaction.
TariffClassify, its owners, and its operators expressly disclaim any liability for losses, penalties, delays, or damages arising from reliance on AI-generated classifications.
4. User accounts and eligibility
You must be at least 18 years old and capable of forming a binding contract to create an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
5. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any regulations
- Attempt to circumvent rate limits, authentication, or access controls
- Submit false, misleading, or fraudulent product information
- Use the Service to file or support customs declarations without professional verification
- Scrape, reverse-engineer, or resell the Service or its output
- Upload content that infringes intellectual property rights or contains malware
6. Credits, payments, and refunds
Certain features require the purchase of classification credits. All purchases are final. We do not offer refunds except where required by applicable law. Credits do not expire. If the Service is discontinued, we will provide a pro-rated refund for unused credits.
7. Data and privacy
Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference. You retain ownership of all product data you submit. By submitting data, you grant us a limited license to process it for the purpose of providing the Service.
All submitted data — including product descriptions, images, and classification results — is automatically deleted after 30 days.
8. Intellectual property
The TariffClassify name, logo, website design, and software are owned by TariffClassify and protected by applicable intellectual property laws. AI-generated classification output is provided to you for your own use but may not be resold or redistributed as a standalone product.
9. Disclaimers and limitation of liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TARIFFCLASSIFY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
10. Indemnification
You agree to indemnify and hold harmless TariffClassify and its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your submission of any product data.
11. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Delaware.
12. Changes to these terms
We reserve the right to modify these Terms at any time. We will notify registered users by email at least 14 days before material changes take effect. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
